定义和说明

《大蒜计数器(Garlic counter)服务协议》（以下简称“本协议”）是用户（以下简称“用户”或您）与大蒜计数器(Garlic counter)之间的协议，大蒜计数器(Garlic counter)将按照本协议约定之内容为您提供服务。请您务必审慎阅读、充分理解各条款内容，若您不同意本协议中所述任何条款或其后对协议条款的修改，请您不要使用大蒜计数器(Garlic counter)及相关服务。您的使用行为将视作对本协议全部条款的完全接受。如果您是未成年人，请在法定监护人的陪同下阅读和判断是否同意本协议，特别注意未成年人使用条款。未成年人行使和履行本协议项下的权利和义务视为已获得监护人的认可。

大蒜计数器(Garlic counter)向您提供包括但不限于如下服务：

  • 大蒜计数器(Garlic counter)平台：大蒜计数器(Garlic counter)网站及客户端；
  • 大蒜计数器(Garlic counter)直接拥有或运营的服务器、网络存储空间；
  • 大蒜计数器(Garlic counter)提供给您的各类增值服务；
  • 大蒜计数器(Garlic counter)提供给您的其他技术和/或服务。

账户的注册、使用及注销

注册

  1. 大蒜计数器(Garlic counter)及相关服务为您提供了注册通道，您有权选择合法的字符组合作为自己的账号，并自行设置符合安全要求的密码。用户设置的账号、密码是用户用以登录并使用大蒜计数器(Garlic counter)及相关服务的凭证。若您为未成年人，大蒜计数器(Garlic counter)将依法根据国家相关法律法规及监管要求限制您的使用行为。
  2. 您理解并承诺，您所设置的账号不得违反国家法律及大蒜计数器(Garlic counter)的相关规则，不得实施任何侵害国家利益、损害其他公民合法权益，有害社会道德风尚的行为，您的账号名称、头像和简介等注册信息及其他个人信息中不得出现违法和不良信息，未经他人许可不得用他人名义（包括但不限于冒用他人姓名、名称、字号、头像等足以让人引起混淆的方式）开设账号，不得恶意注册大蒜计数器(Garlic counter)账号（包括但不限于频繁注册、批量注册账号等行为）。大蒜计数器(Garlic counter)有权对您提交的信息进行审核。您在账户注册使用过程中需遵守法律法规、社会主义制度、国家利益、公民合法权益、社会公共秩序、道德风尚及信息真实性等“七条底线”要求。
  3. 在注册、使用和管理帐号时，您应保证注册帐号时填写的身份信息的真实性，请您在注册、管理帐号时使用真实、准确、合法、有效的相关身份证明材料及必要信息（包括您的姓名及电子邮件地址、联系电话、联系地址等），若国家法律法规有特殊规定，您需要填写真实的身份信息，请您按照相关法律规定完成实名认证，以便我们在必要时与您联系或为您提供更好的服务，并注意及时更新上述相关信息。若您提交的材料或提供的信息不准确、不真实、不合法或者我们有理由怀疑为错误、不实或不合法的资料，则您可能无法使用大蒜计数器(Garlic counter)或服务，或在使用过程中部分功能受到限制。

使用

  1. 您的账号仅限于您本人使用，未经大蒜计数器(Garlic counter)书面同意，禁止以任何形式赠与、借用、出租、转让、售卖或以其他方式许可他人使用该账号。如果大蒜计数器(Garlic counter)发现或者有合理理由认为使用者并非账号初始注册人，为保障账号安全，大蒜计数器(Garlic counter)有权立即暂停或终止向该注册账号提供服务，或注销该账号。
  2. 您有责任维护个人账号、密码的安全性与保密性，并对您以注册账号名义所从事的活动承担全部法律责任，包括但不限于您在大蒜计数器(Garlic counter)及相关服务上进行的任何数据修改、言论发表、款项支付等操作行为可能引起的一切法律责任。您应高度重视对账号与密码的保密，在任何情况下不向他人透露账号及密码。若发现他人未经许可使用您的账号或发生其他任何安全漏洞问题时，您应当立即通知大蒜计数器(Garlic counter)。
  3. 在丢失账号或遗忘密码时，您可遵照大蒜计数器(Garlic counter)的申诉途径及时申诉请求找回账号或密码。您理解并认可，大蒜计数器(Garlic counter)的密码找回机制仅需要识别申诉单上所填资料与系统记录资料具有一致性，而无法识别申诉人是否系真正账号有权使用者。大蒜计数器(Garlic counter)特别提醒您应妥善保管您的账号和密码。当您使用完毕后，应安全退出。如因您保管不当等自身原因或其他不可抗因素导致遭受盗号或密码丢失，您将自行承担相应责任。
  4. 因其他人恶意攻击或您自身原因或其他不可抗因素而导致帐号被盗、丢失，均由您本人承担责任，大蒜计数器(Garlic counter)不承担任何责任。
  5. 大蒜计数器(Garlic counter)依照本协议、相关规则限制您使用帐号全部或部分功能的，可能会给您造成一定的损失，您理解该损失由您自行承担，大蒜计数器(Garlic counter)不承担责任。
  6. 除自行注册大蒜计数器(Garlic counter)账号外，您也可授权使用您合法拥有的包括但不限于大蒜计数器(Garlic counter)和/或其关联公司其他软件用户账号，以及实名注册的第三方软件用户账号登录使用大蒜计数器(Garlic counter)及相关服务，但第三方软件或平台对此有限制或禁止的除外。当您以前述已有账号登录使用的，应保证相应账号已进行实名注册登记，并同样适用本协议中的相关条款。
  7. 您理解并同意，除您登录、使用大蒜计数器(Garlic counter)及相关服务外，您还可以用大蒜计数器(Garlic counter)账号登录使用大蒜计数器(Garlic counter)及其关联公司或合作的第三方提供的其他软件、服务。您以大蒜计数器(Garlic counter)账号登录并使用前述服务时，将受到前述服务的实际提供方的《用户协议》及其他协议条款约束。
  8. 身份要素是我们识别您身份的依据，请您务必妥善保管。使用身份要素进行的操作、发出的指令视为您本人做出。因您的原因造成的账户、密码等信息被冒用、盗用或非法使用，由此引起的风险和损失需要由您自行承担。 您同意，基于不同的终端以及您的使用习惯，我们可能采取不同的验证措施识别您的身份。
  9. 您理解并同意，为了充分使用账号资源，如您在注册后未及时进行初次登录使用或连续超过一年未登录账号使用等情形，大蒜计数器(Garlic counter)有权收回您的账号昵称。

注销

  1. 您有权向大蒜计数器(Garlic counter)提出账号注销申请。注销大蒜计数器(Garlic counter)账号后，您将无法再以此账号登录和使用大蒜计数器(Garlic counter)及相关服务，大蒜计数器(Garlic counter)也将同时终止在该账号下为您提供我们各项产品与服务。且大蒜计数器(Garlic counter)账号一旦注销完成，将无法恢复。请您在注销前慎重考虑。
  2. 如您确定需要注销大蒜计数器(Garlic counter)账号，您已充分知晓并确认，账号注销后您将不再拥有该账号相关的权益，包括但不限于：
  • 账号注销后，您将无法再以该账号登录、使用大蒜计数器(Garlic counter)及相关服务；
  • 账号注销后，您曾通过该账号登录、使用大蒜计数器(Garlic counter)及相关服务的所有内容、信息、数据、记录将会被删除或匿名化处理，您也无法再搜索、访问、获取、使用和找回，包括但不限于：账号信息（头像、昵称、签名等）、绑定信息；
  • 账号注销后，该账号的交易记录将被清空且无法恢复；
  • 您同意通过账号注销的方式放弃该账户在大蒜计数器(Garlic counter)及相关服务中已产生但未消耗完毕的权益及未来的预期权益。
  • 账号注销后，大蒜计数器(Garlic counter)有权不再向用户提供任何与账号有关的服务；
  1. 在您向我们申请注销大蒜计数器(Garlic counter)账号之前，为了保护您的账号安全和财产权益，您需先行检查与确保您申请注销的账号已经同时满足以下条件，包括但不限于：
  • 账号系用户通过官方渠道注册，符合本协议及相关规定的账号；且为您本人的账号；
  • 按照规定的注销流程进行注销操作；
  • 账号处于安全状态，包括：未处于申请找回密码、修改手机号的状态中；无未处理完毕的投诉、举报；其他不安全/异常状态；
  • 账号内无未处理完毕的交易；
  • 其他应满足的条件。
  1. 大蒜计数器(Garlic counter)账号一旦注销，您与我们曾签属过的相关用户协议、其他权利义务性文件等相应终止（但已约定继续生效的或法律另有规定的除外）。同时，您悉知并同意：即使您的账号被注销了，也并不能减轻或免除您在协议期间内应根据相关法律法规、相关协议、规则等（可能）需要承担的相关责任。

知识产权

  1. 大蒜计数器(Garlic counter)及相关服务上的内容，包括但不限于著作、图片、档案、资讯、资料、网站架构、网站画面的安排、网页设计，均由大蒜计数器(Garlic counter)或关联公司依法拥有知识产权，包括但不限于商标权，专利权、著作权、商业秘密等。
  2. 非经大蒜计数器(Garlic counter)或关联公司书面同意，请勿擅自适用、修改、反向编译、复制、公开传播、改变、散布、发行或公开发表大蒜计数器(Garlic counter)及服务中的相关内容。
  3. 除非您与大蒜计数器(Garlic counter)另有书面协议，否则，本服务条款中的任何规定均未授予您使用大蒜计数器(Garlic counter)的任何商品名、商标、服务标记、徽标、域名及其他显著品牌特征的权利。
  4. 尊重知识产权是您应尽的义务，如有违反，您需要承担损害赔偿责任。
  5. 您理解并同意，在使用大蒜计数器(Garlic counter)及相关服务时发布上传的文字、图片、视频、音频等均由您原创或已获合法授权。您通过大蒜计数器(Garlic counter)上传、发布的任何内容的知识产权归属您或原始著作权人所有。如果第三方提出关于著作权或其他合法权益的异议，大蒜计数器(Garlic counter)有权根据实际情况删除相关的内容，且有权追究您的法律责任。给大蒜计数器(Garlic counter)或任何第三方造成损失的，您应负责全额赔偿。

  1. 在任何情况下，大蒜计数器(Garlic counter)一旦合理地认为用户地行为可能违反上述法律、法规，可以在任何时候，不经事先通知终止向该用户提供服务。
  2. 禁止用户从事以下行为：
  • 制作、上传、复制、传送、传播包含任何反对宪法所确定的基本原则、危害国家安全、泄露国家秘密、颠覆国家政权、破坏国家统一、破坏民族团结、损害国家荣誉和利益、煽动民族仇恨、民族歧视、破坏民族团结、破坏国家宗教政策、宣扬邪教和封建迷信、淫秽、色情、赌博、暴力、凶杀、恐怖或者教唆犯罪、侮辱或者诽谤他人，侵害他人合法权益的等法律、行政法规禁止的内容或其他令人反感的包括但不限于资讯、资料、文字、软件、音乐、照片、图形、信息或其他资料；
  • 伪造标题或以其他方式操控识别资料，使人误认为该内容为大蒜计数器(Garlic counter)所传送；
  • 将无权传送的内容（例如内部资料、机密资料）进行上载、张贴、发送电子邮件或以其他方式传送；
  • 将侵犯任何人的专利、商标、著作权、商业秘密等知识产权的内容加以上载、张贴、发送电子邮件或以其他方式传送；
  • 将广告函件、促销资料、"垃圾邮件"等，加以上载、张贴、发送电子邮件或以其他方式传送；
  • 将有关干扰、破坏或限制任何计算机软件、硬件或通讯设备功能的软件病毒或其他计算机代码、档案和程序之资料，加以上载、张贴、发送电子邮件或以其他方式传送；
  • 用户需保证其上传内容不得违反广电总局的相关规定，包括但不限于《互联网视听节目服务管理规定》（广电总局 56 号令）等，其上传节目应当符合法律、行政法规、部门规章的规定，上传内容不得含有以下内容：
    1. 反对宪法确定的基本原则的；
    2. 危害国家统一、主权和领土完整的；
    3. 泄露国家秘密、危害国家安全或者损害国家荣誉和利益的；
    4. 煽动民族仇恨、民族歧视，破坏民族团结，或者侵害民族风俗、习惯的；
    5. 扰乱社会秩序，破坏社会稳定的；
    6. 诱导未成年人违法犯罪和渲染暴力、色情、赌博、恐怖活动的；
    7. 侮辱或者诽谤他人，侵害公民个人隐私等他人合法权益的；
    8. 危害社会公德，损害民族优秀文化传统的；
    9. 有关法律、行政法规和国家规定禁止的其他内容。 如用户提供的上传内容含有以上违反政策法律法规的信息或者内容的，由用户直接承担以上导致的一切不利后果，如因此给大蒜计数器(Garlic counter)造成不利后果的，用户应负责消除影响，并且赔偿因此导致的一切损失。
  • 以任何方式危害未成年人；
  • 冒充任何人或机构，或以虚伪不实的方式谎称或使人误认为与任何人或任何机构有关；
  • 干扰或破坏大蒜计数器(Garlic counter)及相关服务或与大蒜计数器(Garlic counter)及服务相连的服务器和网络，或不遵守本协议之规定；
  • 故意或非故意违反任何相关的中国法律、法规、规章、条例等其他具有法律效力的规范；
  • 未经大蒜计数器(Garlic counter)事先明确书面许可，以任何方式（包括但不限于机器人软件、蜘蛛软件、爬虫软件等任何自动程序、脚本、软件）和任何理由自行或委托他人、协助他人获取平台的服务、内容、数据；

免责声明

  1. 因下列原因导致我们无法正常提供服务，我们免于承担责任：
  • 我们的系统停机维护或升级；
  • 因台风、地震、洪水、雷电或恐怖袭击等不可抗力原因；
  • 您的设备软硬件和通信线路、供电线路出现故障的；
  • 因您操作不当或通过非经我们授权或认可的方式使用我们服务的；
  • 因病毒、木马、恶意程序攻击、网络拥堵、系统不稳定、系统或设备故障、通讯故障、电力故障、银行原因、第三方服务瑕疵或政府行为等原因。

尽管有前款约定，我们将采取合理行动积极促使服务恢复正常。

  1. 在任何情况下，大蒜计数器(Garlic counter)均不对任何间接性、后果性、惩罚性、偶然性、特殊性或刑罚性的损害，包括因您使用大蒜计数器(Garlic counter)及相关服务而遭受的利润损失，承担责任。大蒜计数器(Garlic counter)对您承担的全部责任，无论因何原因或何种行为方式，始终不超过您在因使用大蒜计数器(Garlic counter)软件及相关服务而支付给大蒜计数器(Garlic counter)的费用(如有)。

广告

对于任何涉财产的网络信息、帐户密码、借款、广告或推广等信息的，用户请谨慎对待并自行进行判断，基于前述原因您遭受的利润、商业信誉、资料损失或其他有形或无形损失，大蒜计数器(Garlic counter)不承担任何直接、间接、附带、特别、衍生性或惩罚性的赔偿责任。

用户上传内容

  1. 用户上传至大蒜计数器(Garlic counter)的内容仅表明个人的立场和观点，并不代表我方的立场或观点。作为内容的发布者，需自行对所发表内容负责，因所发表内容引发的一切纠纷，由该内容的发表者承担全部法律集连带责任。大蒜计数器(Garlic counter)不承担任何法律及连带责任。
  2. 大蒜计数器(Garlic counter)不能对用户发布、上传、传播或转载的内容的正确性进行保证。

  4. 您理解并同意，本协议是在保障遵守国家法律法规、维护公序良俗，保护他人合法权益，大蒜计数器(Garlic counter)在能力范围内尽最大的努力按照相关法律法规进行判断，但并不保证大蒜计数器(Garlic counter)判断完全与司法机关、行政机关的判断一致，如因此产生的后果您已经理解并同意自行承担。

法律的适用和管辖

本协议之效力、解释、变更、执行与争议解决均适用中华人民共和国法律。您因使用我方服务所产生及与我方平台服务有关的争议，由我方与您协商解决。协商不成时，任何一方均可向被告所在地人民法院提起诉讼。

服务的变更、中断和终止

  1. 您理解并同意，大蒜计数器(Garlic counter)基于经营策略的调整，可能会对服务内容进行变更，也可能会中断、中止或终止服务。
  2. 您理解并同意，如大蒜计数器(Garlic counter)发生合并、分立、收购、资产转让时，大蒜计数器(Garlic counter)可向第三方转让本服务下相关资产；大蒜计数器(Garlic counter)亦可在单方通知您后，将本协议下部分或全部服务及相应的权利义务转交由第三方运营或履行。
  3. 您理解并同意，如您违反相关法律法规的规定、违反本协议及其他大蒜计数器(Garlic counter)相关约定，大蒜计数器(Garlic counter)有权不经通知而单方中断或终止向您提供服务。
  4. 大蒜计数器(Garlic counter)终止向您提供服务后，有权根据适用法律的要求删除您的个人信息，或使其匿名化处理，亦有权依照法律法规的期限和方式继续保存您留存于我方平台的其他内容和信息。
  5. 您理解并同意，大蒜计数器(Garlic counter)运营方需要定期或不定期地对提供的服务或相关的设备进行维护或检修，如因此类情况而造成服务在合理时间内的中断，大蒜计数器(Garlic counter)运营方无需为此承担任何责任，但大蒜计数器(Garlic counter)运营方应尽可能事先进行通告。

广告

  1. 您在使用大蒜计数器(Garlic counter)及相关服务过程中，充分理解并同意：本服务中可能包括大蒜计数器(Garlic counter)针对个人或企业推出的信息、广告发布或品牌推广服务，您同意大蒜计数器(Garlic counter)及相关服务中展示大蒜计数器(Garlic counter)和/或第三方供应商、合作伙伴的商业广告、推广或信息（包括商业或非商业信息）。
  2. 如您不同意任何一则广告，您有权选择关闭该广告或停止使用大蒜计数器(Garlic counter)及相关服务。
  3. 大蒜计数器(Garlic counter)依照法律法规履行广告及推广相关义务，您应当自行判断任何一则广告或推广信息的真实性和可靠性并为自己的判断行为负责。除法律法规明确规定外，您因该广告或推广信息进行的购买、交易或因前述内容遭受的损害或损失，用户应自行承担，大蒜计数器(Garlic counter)不承担责任。
  4. 大蒜计数器(Garlic counter)在服务中投放广告的方式、形式和范围会发生变更，恕不另行通知。

费用条款

未成年人使用条款

Garlic Counter Service Agreement

Definitions and explanation

This Garlic Counter Service Agreement (the “Agreement”) is an agreement between the user (the “User” or “you”) and Garlic Counter. Garlic Counter will provide services to you in accordance with this Agreement. Please read all provisions carefully and make sure you fully understand them. If you disagree with any provision of this Agreement or any subsequent amendment, please do not use Garlic Counter or its related services. Your use will be deemed full acceptance of all provisions of this Agreement. If you are a minor, please read this Agreement with your legal guardian and decide whether to accept it, paying particular attention to the provisions on use by minors. A minor’s exercise of rights and performance of obligations under this Agreement will be deemed approved by their guardian.

Garlic Counter provides services including, but not limited to, the following:

  • The Garlic Counter platform: the Garlic Counter website and client applications;
  • Servers and network storage space directly owned or operated by Garlic Counter;
  • Various value-added services provided to you by Garlic Counter;
  • Other technologies and/or services provided to you by Garlic Counter.

Account registration, use and deletion

Registration

  1. Garlic Counter and its related services provide a registration channel. You may choose a lawful combination of characters as your account identifier and set a password that meets security requirements. The account identifier and password you set are your credentials for signing in to and using Garlic Counter and its related services. If you are a minor, Garlic Counter will restrict your use in accordance with applicable national laws, regulations and regulatory requirements.
  2. You understand and undertake that the account you create must not violate national law or Garlic Counter’s rules. You must not engage in conduct that infringes national interests, harms other citizens’ lawful rights and interests, or undermines public morals. Your account name, avatar, profile and other registration or personal information must not contain unlawful or harmful information. You must not open an account in another person’s name without permission, including by using another person’s name, business name, trade name, avatar or other means likely to cause confusion. You must not maliciously register Garlic Counter accounts, including frequent or bulk registration. Garlic Counter may review the information you submit. During account registration and use, you must comply with the “seven bottom lines”: laws and regulations, the socialist system, national interests, citizens’ lawful rights and interests, public order, moral standards and the authenticity of information.
  3. When registering, using and managing an account, you must ensure that the identity information you provide is authentic. Please use authentic, accurate, lawful and valid identity documents and necessary information, including your name, email address, telephone number and contact address. Where national laws or regulations specifically require authentic identity information, please complete real-name verification as required so that we can contact you when necessary or provide better services. Keep this information up to date. If the documents or information you submit are inaccurate, untrue or unlawful, or we have reason to suspect that they are incorrect, false or unlawful, you may be unable to use Garlic Counter or its services, or some functions may be restricted.

Use

  1. Your account is for your own use only. Without Garlic Counter’s written consent, you must not give away, lend, rent, transfer, sell or otherwise permit another person to use it. If Garlic Counter discovers or reasonably believes that the person using an account is not its original registrant, Garlic Counter may immediately suspend or terminate services to that account, or delete it, to protect account security.
  2. You are responsible for maintaining the security and confidentiality of your account and password and bear all legal responsibility for activities carried out under your registered account, including any liability arising from data changes, statements, payments and other actions on Garlic Counter and its related services. Treat your account and password as strictly confidential and do not disclose them to anyone under any circumstances. If you discover unauthorized use of your account or any other security breach, notify Garlic Counter immediately.
  3. If you lose your account or forget your password, you may promptly request recovery through Garlic Counter’s appeal process. You understand and acknowledge that Garlic Counter’s password recovery mechanism can only determine whether the information in the appeal matches system records; it cannot determine whether the applicant is the person actually entitled to use the account. Garlic Counter specifically reminds you to safeguard your account and password and sign out securely when you finish using the service. You bear the corresponding responsibility for account theft or password loss caused by your own actions, such as improper safekeeping, or other circumstances beyond control.
  4. You bear responsibility if your account is stolen or lost due to malicious attacks by others, your own actions or other circumstances beyond control. Garlic Counter assumes no liability.
  5. Restrictions imposed by Garlic Counter on all or part of your account’s functions under this Agreement or related rules may cause you losses. You understand that you bear those losses and Garlic Counter assumes no liability.
  6. In addition to registering a Garlic Counter account directly, you may authorize sign-in to Garlic Counter and its related services using accounts you lawfully own, including accounts for other software provided by Garlic Counter and/or its affiliates and real-name-registered third-party software accounts, unless the third-party software or platform restricts or prohibits this. When signing in with such an existing account, you must ensure that it has completed real-name registration. The relevant provisions of this Agreement also apply.
  7. You understand and agree that, in addition to signing in to and using Garlic Counter and its related services, you may use your Garlic Counter account to sign in to other software and services provided by Garlic Counter, its affiliates or cooperating third parties. When you use your Garlic Counter account for those services, you are subject to the User Agreement and other contractual terms of their actual provider.
  8. Identity credentials are the basis on which we identify you, so please safeguard them. Actions taken and instructions issued using those credentials are deemed to be yours. You bear the risks and losses arising from impersonation, theft or unlawful use of your account, password or other information due to reasons attributable to you. You agree that we may use different verification measures to identify you based on the device you use and your usage habits.
  9. You understand and agree that, to make full use of account resources, Garlic Counter may reclaim your account nickname if you do not make your first sign-in promptly after registration, do not sign in for more than one consecutive year, or in similar circumstances.

Deletion

  1. You may request deletion of your Garlic Counter account. Once the account is deleted, you will no longer be able to sign in to or use Garlic Counter and its related services with that account, and Garlic Counter will stop providing all of our products and services under it. Account deletion cannot be reversed. Please consider carefully before deleting your account.
  2. If you decide to delete your Garlic Counter account, you fully acknowledge and confirm that you will no longer hold the rights and benefits associated with it, including, but not limited to, the following:
  • After deletion, you will no longer be able to sign in to or use Garlic Counter and its related services with that account;
  • After deletion, all content, information, data and records associated with your sign-in to and use of Garlic Counter and its related services through the account will be deleted or anonymized. You will no longer be able to search for, access, obtain, use or recover them, including account information such as your avatar, nickname and signature, and linked information;
  • After deletion, the account’s transaction records will be cleared and cannot be recovered;
  • By deleting the account, you agree to relinquish benefits already accrued but not fully used, and expected future benefits, associated with the account in Garlic Counter and its related services.
  • After deletion, Garlic Counter may cease providing any account-related services to the user;
  1. Before applying to delete your Garlic Counter account, you must first check and ensure, to protect your account security and property interests, that the account meets all applicable conditions, including, but not limited to, the following:
  • The account was registered through official channels, complies with this Agreement and relevant rules, and belongs to you;
  • You follow the prescribed account deletion procedure;
  • The account is in a secure state: no password recovery or phone number change is in progress, there are no unresolved complaints or reports, and there are no other insecure or abnormal conditions;
  • There are no outstanding transactions in the account;
  • All other applicable conditions are met.
  1. Once your Garlic Counter account is deleted, the relevant user agreements and other documents concerning rights and obligations previously entered into between you and us terminate accordingly, except for provisions agreed to survive or where otherwise provided by law. You also acknowledge and agree that account deletion does not reduce or release any liability you may bear under applicable laws, regulations, agreements or rules for the period during which the Agreement was in effect.

Intellectual property

  1. Intellectual property rights in the content of Garlic Counter and its related services, including works, images, files, information, materials, website architecture, screen arrangements and web design, are lawfully owned by Garlic Counter or its affiliates. These rights include trademarks, patents, copyright and trade secrets.
  2. Without written consent from Garlic Counter or its affiliates, do not use, modify, decompile, copy, publicly communicate, alter, disseminate, distribute or publicly publish the relevant content of Garlic Counter and its services.
  3. Unless you have a separate written agreement with Garlic Counter, nothing in these service terms grants you any right to use Garlic Counter’s trade names, trademarks, service marks, logos, domain names or other distinctive brand features.
  4. You are obliged to respect intellectual property rights. If you infringe them, you must bear liability for damages.
  5. You understand and agree that text, images, videos, audio and other materials you upload or publish while using Garlic Counter and its related services must be your original work or lawfully authorized. Intellectual property rights in content you upload or publish through Garlic Counter belong to you or the original copyright holder. If a third party objects on the grounds of copyright or other lawful rights and interests, Garlic Counter may remove the relevant content as appropriate and pursue your legal liability. You must fully compensate Garlic Counter or any third party for losses you cause.

Privacy protection

Garlic Counter fully respects the protection of users’ personal information. Garlic Counter’s Privacy Policy explains how Garlic Counter processes your personal information when you use Garlic Counter and its related services. By using Garlic Counter and its related services, you agree that Garlic Counter may process the relevant information in accordance with the Privacy Policy.

User conduct

  1. When using Garlic Counter and its related services, you must comply with the following laws and regulations:
  • Law of the People’s Republic of China on Guarding State Secrets;
  • Copyright Law of the People’s Republic of China;
  • Regulations of the People’s Republic of China on the Security Protection of Computer Information Systems;
  • Regulations on the Protection of Computer Software;
  • Provisions on the Administration of Internet Electronic Bulletin Services;
  • Regulations on the Protection of the Right of Communication through Information Networks;
  • Cybersecurity Law of the People’s Republic of China;
  • Other laws and regulations concerning computers and the Internet.
  1. If Garlic Counter reasonably believes that a user’s conduct may violate the laws or regulations listed above, Garlic Counter may terminate services to that user at any time without prior notice.
  2. Users are prohibited from engaging in the following conduct:
  • Producing, uploading, copying, transmitting or disseminating content that opposes the fundamental principles established by the Constitution, endangers national security, discloses state secrets, subverts state power, undermines national unity or ethnic solidarity, harms national honor or interests, incites ethnic hatred or discrimination, undermines national religious policy, promotes cults or feudal superstition, contains obscenity, pornography, gambling, violence, homicide or terrorism, incites crime, insults or defames others, infringes others’ lawful rights and interests, or is otherwise prohibited by laws or administrative regulations or objectionable, including information, materials, text, software, music, photographs, graphics, messages and other material;
  • Forging headers or otherwise manipulating identifying information to create the impression that content was transmitted by Garlic Counter;
  • Uploading, posting, emailing or otherwise transmitting content you are not entitled to transmit, such as internal or confidential materials;
  • Uploading, posting, emailing or otherwise transmitting content that infringes anyone’s patents, trademarks, copyright, trade secrets or other intellectual property rights;
  • Uploading, posting, emailing or otherwise transmitting advertising letters, promotional materials, spam or similar content;
  • Uploading, posting, emailing or otherwise transmitting software viruses or other computer code, files or programs intended to interfere with, destroy or limit the functions of computer software, hardware or communication equipment;
  • Users must ensure that uploaded content does not violate relevant broadcasting authority rules, including the Provisions on the Administration of Internet Audiovisual Program Services (Broadcasting Authority Order No. 56). Uploaded programs must comply with laws, administrative regulations and departmental rules and must not contain any of the following:
    1. Content opposing the fundamental principles established by the Constitution;
    2. Content endangering national unity, sovereignty or territorial integrity;
    3. Content disclosing state secrets, endangering national security, or harming national honor or interests;
    4. Content inciting ethnic hatred or discrimination, undermining ethnic solidarity, or infringing ethnic customs or practices;
    5. Content disturbing public order or undermining social stability;
    6. Content inducing minors to break the law or commit crimes, or portraying violence, pornography, gambling or terrorist activities;
    7. Content insulting or defaming others, or infringing others’ lawful rights and interests, such as personal privacy;
    8. Content harming public morals or the fine cultural traditions of the nation;
    9. Other content prohibited by applicable laws, administrative regulations or state rules. If uploaded content contains information or material that violates the policies, laws or regulations above, the user directly bears all resulting adverse consequences. If Garlic Counter suffers adverse consequences as a result, the user must eliminate their effects and compensate all resulting losses.
  • Harming minors in any way;
  • Impersonating any person or organization, or falsely claiming or creating the impression of an association with any person or organization;
  • Interfering with or disrupting Garlic Counter and its related services, or the servers and networks connected to them, or failing to comply with this Agreement;
  • Intentionally or unintentionally violating applicable Chinese laws, regulations, rules, ordinances or other legally binding requirements;
  • Without Garlic Counter’s prior express written permission, obtaining platform services, content or data, either independently or by commissioning or assisting others, by any means, including bots, spiders, crawlers or other automated programs, scripts or software, and for any reason;

Disclaimer

  1. We are exempt from liability if we cannot provide services normally for any of the following reasons:
  • System downtime for maintenance or upgrades;
  • Force majeure events such as typhoons, earthquakes, floods, lightning or terrorist attacks;
  • Failures of your device’s hardware or software, communication lines or power supply;
  • Your improper operation or use of our services in a manner we have not authorized or approved;
  • Viruses, Trojan horses, malicious program attacks, network congestion, system instability, system or equipment failures, communication failures, power failures, banking issues, defects in third-party services, government action or similar causes.

Notwithstanding the preceding provisions, we will take reasonable action to actively restore normal services.

  1. Under no circumstances is Garlic Counter liable for indirect, consequential, exemplary, incidental, special or punitive damages, including lost profits arising from your use of Garlic Counter and its related services. Garlic Counter’s total liability to you, regardless of the cause or form of action, will never exceed the fees, if any, you paid to Garlic Counter for using its software and related services.

Advertising

Users should exercise caution and independent judgment about online information concerning property, account passwords, loans, advertising or promotions. Garlic Counter is not liable for any direct, indirect, incidental, special, consequential, exemplary or punitive compensation for losses of profits, goodwill, data or other tangible or intangible losses suffered for those reasons.

User-uploaded content

  1. Content uploaded by users to Garlic Counter represents only their personal positions and views, not ours. Publishers are responsible for their own content and bear all legal and joint liability for disputes arising from it. Garlic Counter assumes no legal or joint liability.
  2. Garlic Counter cannot guarantee the accuracy of content published, uploaded, transmitted or reposted by users.
  3. The right to handle unlawful or noncompliant content granted to Garlic Counter under this Agreement does not constitute an obligation or commitment. Garlic Counter cannot guarantee timely discovery or handling of unlawful conduct and will comply with applicable laws and regulations.
  4. You understand and agree that, to uphold national laws and regulations, maintain public order and good morals, and protect others’ lawful rights and interests under this Agreement, Garlic Counter makes its best efforts within its capabilities to assess matters in accordance with applicable laws and regulations. Garlic Counter does not guarantee that its assessments will be entirely consistent with those of judicial or administrative authorities. You understand and agree to bear any resulting consequences yourself.

Applicable law and jurisdiction

The validity, interpretation, amendment, performance and dispute resolution of this Agreement are governed by the laws of the People’s Republic of China. Disputes arising from your use of our services or relating to our platform services will be resolved through consultation between you and us. If consultation fails, either party may bring proceedings before the people’s court at the defendant’s location.

Changes, interruption and termination of services

  1. You understand and agree that Garlic Counter may change, interrupt, suspend or terminate services as a result of adjustments to its business strategy.
  2. You understand and agree that, in the event of a merger, division, acquisition or asset transfer involving Garlic Counter, Garlic Counter may transfer relevant assets under these services to a third party. Garlic Counter may also, after giving you unilateral notice, transfer some or all services under this Agreement and their corresponding rights and obligations to a third party for operation or performance.
  3. You understand and agree that, if you violate applicable laws or regulations, this Agreement or other relevant agreements with Garlic Counter, Garlic Counter may unilaterally interrupt or terminate services to you without notice.
  4. After terminating services to you, Garlic Counter may delete or anonymize your personal information as required by applicable law. Garlic Counter may also continue retaining other content and information you have left on our platform for the periods and in the manner prescribed by laws and regulations.
  5. You understand and agree that the operator of Garlic Counter needs to maintain or inspect the services and related equipment regularly or from time to time. The operator is not liable for service interruptions lasting a reasonable period as a result, but should give advance notice whenever possible.

Advertising

  1. When using Garlic Counter and its related services, you fully understand and agree that the services may include information, advertising publication or brand promotion services launched by Garlic Counter for individuals or businesses. You agree to the display of commercial advertisements, promotions or information, whether commercial or noncommercial, from Garlic Counter and/or third-party suppliers and partners in Garlic Counter and its related services.
  2. If you disagree with an advertisement, you may close it or stop using Garlic Counter and its related services.
  3. Garlic Counter performs its advertising and promotion obligations in accordance with laws and regulations. You must assess the truthfulness and reliability of advertisements or promotional information yourself and take responsibility for your judgment. Unless expressly provided otherwise by law or regulation, you bear responsibility for purchases or transactions made on the basis of such advertising or promotional information and for resulting harm or loss; Garlic Counter assumes no liability.
  4. The methods, formats and scope of advertisements displayed in Garlic Counter’s services may change without further notice.

Fees

  1. When purchasing services within Garlic Counter, carefully confirm important matters such as the service duration, content and restrictions.
  2. Garlic Counter may determine the charging methods and rates for its in-app services and adjust its pricing policies at any time as needed. Garlic Counter does not provide price protection or refunds if a service is subsequently discounted or promoted.
  3. Payment methods used to purchase Garlic Counter’s in-app services are provided by third parties. Garlic Counter is not liable for delays, errors or other problems that may occur during payment.

Use by minors

  1. Garlic Counter places great importance on protecting minors. If you are a minor, read this Agreement under your guardian’s supervision and guidance, and use Garlic Counter and its related services only after obtaining your guardian’s consent.
  2. Minor users understand that, if they violate laws, regulations or this Agreement, they and their guardians must bear all resulting legal liability in accordance with laws and regulations.
  3. To better protect minors’ privacy rights, Garlic Counter reminds you to exercise caution when publishing content involving minors. Publication is deemed the user’s consent for Garlic Counter and its related services to display minors’ information, likenesses, voices and similar material, and permission for Garlic Counter to use and process that content in accordance with this Agreement.

Third-party links

Garlic Counter and its related services may provide links to other websites or resources on the Internet. Unless otherwise stated, Garlic Counter cannot control the services of third-party websites and is not liable for loss or damage arising from your use of or reliance on those websites or resources. We recommend that you carefully read their terms of service and privacy policies before leaving Garlic Counter to access other websites or resources.

Changes to terms and notices

Garlic Counter may amend this Agreement when necessary. Please review its contents regularly. Continued use of the services covered by this Agreement is deemed acceptance of the amendments. If you disagree with the amendments, you should terminate this Agreement and stop using the relevant services.
